These Terms of Service ("Terms") govern your access to and use of the Alive Portal (the "Services"), the authenticated application operated by Alive Healthcare Technologies LLC ("Alive") that connects volunteers, staff, administrators, researchers, and healthcare providers to the healthcare organizations they are affiliated with (each, a "Customer Organization"), including but not limited to the American Lung Cancer Screening Initiative ("ALCSI"). References to "we," "us," or "our" mean Alive. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Alive builds and operates the Services on behalf of Customer Organizations. Your Customer Organization determines the program, policies, and eligibility rules that apply to your participation, and may require you to also agree to its own organization-specific terms, notices, or consent forms. For example, ALCSI members are additionally bound by ALCSI's own Terms of Service and Privacy Policy at alcsi.live/terms. If these Terms conflict with your Customer Organization's own terms regarding your use of that organization's program, the Customer Organization's terms control for that program; these Terms otherwise govern your use of the Services generally.
The Services are provided for informational, educational, administrative, research, and care-coordination purposes only, as applicable to your role and Customer Organization. Any eligibility checks, screening information, or related content provided through the Services are intended to support each Customer Organization's program and to help connect individuals with appropriate resources.
The Services do not provide medical advice, diagnosis, or treatment, and are not a substitute for professional medical care. Nothing in the Services should be interpreted as a recommendation regarding any specific course of medical action. Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition or screening eligibility.
Any eligibility screener, calculator, or similar feature within the Services is a general informational tool based on publicly available guidelines. It is not a diagnostic tool, does not constitute a medical evaluation, and should not be relied upon as a definitive determination of health status or eligibility for any procedure. Final eligibility determinations should be made by a licensed healthcare provider.
Access to any part of the Services — including the volunteer, administration, research, provider, or navigation areas — is granted only through an approved membership, staff assignment, or access grant tied to a specific Customer Organization, and is limited to that organization's own data. Access to more than one Customer Organization requires a separate approved membership or grant for each; using the Services to reach data belonging to a Customer Organization you are not authorized for is prohibited.
You are solely responsible for how you use the Services and any decisions you make based on information obtained through them, including decisions made while acting on behalf of a Customer Organization and any information you choose to share with members of the public in that capacity.
When using the Services, you agree that you will not:
Access to the Services is granted at the discretion of your Customer Organization and/or Alive, and may be suspended or terminated at any time, including for violations of these Terms, misuse of the platform, loss of your affiliation with your Customer Organization, or upon request of your Customer Organization.
To the fullest extent permitted by law, Alive, the Customer Organizations, and their respective officers, directors, employees, volunteers, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of, or inability to use, the Services, including but not limited to damages for personal injury, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages. The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied.
All content, branding, graphics, software, and materials provided through the Services are the property of Alive, the relevant Customer Organization, or their licensors and may not be copied, reproduced, or distributed without permission, except as necessary for authorized activity on behalf of a Customer Organization.
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or operations. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
